{"id":496370,"date":"2025-01-23T13:51:52","date_gmt":"2025-01-23T08:21:52","guid":{"rendered":"https:\/\/inc42.com\/?p=496370"},"modified":"2025-01-23T13:51:52","modified_gmt":"2025-01-23T08:21:52","slug":"nclat-stays-cci-ban-on-whatsapp-meta-data-sharing-policy-report","status":"publish","type":"post","link":"https:\/\/inc42.com\/buzz\/nclat-stays-cci-ban-on-whatsapp-meta-data-sharing-policy-report\/","title":{"rendered":"NCLAT Stays CCI Ban On WhatsApp-Meta Data Sharing Policy: Report"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The National Company Law Appellate Tribunal (NCLAT) has reportedly granted interim relief to Meta platforms by staying the five-year ban imposed by the Competition Commission of India (CCI) on WhatsApp\u2019s data sharing policy.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As per Reuters, the ban \u201cmay lead to a collapse\u201d of WhatsApp&#8217;s business model, the appeals tribunal noted.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In its challenge to the ban, Meta told the appeals tribunal that WhatsApp would <\/span><a href=\"https:\/\/inc42.com\/buzz\/meta-says-cci-ruling-may-force-it-to-roll-back-some-features\/\" target=\"_blank\" rel=\"false noopener\"><span style=\"font-weight: 400;\">need to \u2018roll back or pause\u2019<\/span><\/a><span style=\"font-weight: 400;\"> some features in India and curb its ability to offer users personalised ads on Facebook and Instagram, the report said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under the order on Thursday, WhatsApp will have to provide an opt-out option to users from a 2021 privacy policy update in line with the November antitrust order.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In November, the CCI <\/span><a href=\"https:\/\/inc42.com\/buzz\/nclat-to-hear-metas-plea-against-cci-penalty-on-january-16\/\" target=\"_blank\" rel=\"false noopener\"><span style=\"font-weight: 400;\">imposed a INR 213.14 Cr<\/span><\/a><span style=\"font-weight: 400;\"> penalty on Meta for abuse of dominant position. The watchdog said the data sharing between WhatsApp and Meta would create entry barriers for competitors.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The case originated from a 2021 Delhi High Court petition where two individuals challenged WhatsApp&#8217;s policy update, citing privacy concerns.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This development comes amid Meta&#8217;s ongoing challenges in India. On January 15, the company apologised for CEO Mark Zuckerberg&#8217;s <\/span><a href=\"https:\/\/inc42.com\/buzz\/inadvertent-error-meta-apologises-for-zuckerbergs-ls-elections-remark\/\" target=\"_blank\" rel=\"false noopener\"><span style=\"font-weight: 400;\">comments about Indian elections<\/span><\/a><span style=\"font-weight: 400;\"> made during a Joe Rogan podcast.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The apology followed BJP MP Nishikant Dubey&#8217;s announcement that the parliamentary panel on IT would summon Meta officials over the remarks. Dubey, who heads the panel, said the company would need to apologise to the Indian Parliament and people for spreading misinformation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Meta also\u00a0 faces other regulatory challenges in India, including issues with service reliability and <\/span><a href=\"https:\/\/inc42.com\/buzz\/parl-panel-to-summon-meta-over-ceos-comments-on-lok-sabha-polls\/\" target=\"_blank\" rel=\"false noopener\"><span style=\"font-weight: 400;\">addressing fake news<\/span><\/a><span style=\"font-weight: 400;\"> on its platforms.
